Welcome to The Warm Soul. These Terms of Use ("Terms") govern your access to and use of The Warm Soul mobile application and website at TheWarmSoul.org (collectively, the "Service"), operated by MindCare Central LLC, doing business as The Warm Soul ("we," "our," or "us").

By creating an account, downloading the app, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About The Warm Soul

The Warm Soul is a faith-based wellness app for Christian women, offering audio challenges, a prayer library, and related content designed for spiritual reflection and emotional encouragement throughout life's seasons.

2. Eligibility

You must be at least 13 years old to use the Service. By using The Warm Soul, you represent that:

  • You are 13 years of age or older

  • You have the legal capacity to enter into these Terms

  • You will use the Service in compliance with these Terms and all applicable laws

If you are between 13 and the age of majority in your jurisdiction, you confirm that you have permission from a parent or legal guardian to use the Service.

3. Account Registration

4. Subscriptions, Pricing, and Auto-Renewal

The Warm Soul is free to download. Certain features and content are available only through a paid subscription:

  • Monthly Plan: $7.99 per month

  • Annual Plan: $59.99 per year

  • 7-Day Free Trial: Available to new subscribers

a. Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.

b. Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of your current billing period — you will retain access to paid content until that time.

c. Refunds

All subscription refunds are handled by Apple in accordance with their App Store policies. We are unable to issue refunds directly for in-app purchases.

d. Price Changes

We reserve the right to change subscription pricing at any time. We will provide reasonable advance notice of any price changes, and continued use after the change takes effect constitutes acceptance of the new pricing.

5. Acceptable Use

You agree to use The Warm Soul only for its intended purposes. You will not:

  • Use the Service in any unlawful manner or for any unlawful purpose

  • Reproduce, copy, sell, resell, or distribute any portion of the Service or its content without our written permission

  • Attempt to gain unauthorized access to any part of the Service, our servers, or related systems

  • Reverse engineer, decompile, or attempt to extract the source code of the app

  • Use any automated system (bots, scrapers, crawlers) to access the Service

  • Impersonate any person or entity or misrepresent your affiliation with anyone

  • Use the Service to harass, abuse, or harm another person

Violation of these terms may result in immediate suspension or termination of your account.

6. Intellectual Property

All content provided through The Warm Soul — including but not limited to prayers, audio challenges, devotional content, written reflections, scripture compilations, branding, logos, graphics, and design — is the property of MindCare Central LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use only. You may not redistribute, publish, share, or commercially exploit any content from the Service without our express written permission.

7. Wellness Disclaimer

The Warm Soul provides faith-based wellness content for personal reflection and spiritual encouragement. The Service is not intended to diagnose, treat, cure, or prevent any medical or mental health condition.

The content offered through the Service is not a substitute for professional medical advice, psychological counseling, therapy, or treatment. If you are experiencing a medical or mental health concern, please consult a licensed healthcare provider.

MindCare Central LLC, its founder, and its affiliates are not licensed medical or mental health professionals, and nothing in the Service constitutes professional medical or psychological advice.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

You agree to indemnify, defend, and hold harmless MindCare Central LLC, its founder, employees, and affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, harms other users, or is otherwise harmful to our interests.

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of the page. Material changes will be communicated through the Service or by email when reasonable. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida. You consent to the personal jurisdiction of such courts.

Before filing any formal legal action, you agree to first contact us in good faith through TheWarmSoul.org/contact to attempt to resolve the dispute informally.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MindCare Central LLC regarding your use of the Service.
